1. Eligibility

● Users must be residents of India.
● Prescription drugs can only be purchased with a valid prescription from a registered medical practitioner as per Drugs and Cosmetics Act, 1940 and Rules, 1945.
2. Products and Services
Swasthkart.com sells:
● Ayurvedic medicines
● Allopathic medicines (Schedule H drugs require prescription)
● Health monitoring devices (BP machines, glucometers, thermometers, etc.)
● Pathology test booking and home sample collection services (within serviceable cities only)
Important Notes:
● We do not sell Schedule X drugs, narcotic drugs, psychotropic substances, or any prohibited items under Narcotic Drugs and Psychotropic Substances Act, 1985.
● All prescription medicines require uploading a valid prescription at checkout.
● OTC (Over-the-Counter) medicines and health devices do not require prescription.
3. User Registration and Account
● Registration is mandatory for placing orders.
● You agree to provide accurate information during registration.
● You are responsible for maintaining the confidentiality of your account credentials.
● Notify us immediately of any unauthorized use.
4. Orders and Payment
● All orders are subject to availability and approval.
● Prices are in Indian Rupees (INR) and exclude taxes/shipping unless specified.
● Payment gateways are secure; we do not store payment details.
● GST as applicable will be charged.
5. Prescription Verification (As per Drugs and Cosmetics Rules)
● Upload valid prescription for Schedule H/H1 drugs.
● Prescriptions are verified by our registered pharmacist before dispatch.
● Invalid/expired prescriptions will result in order cancellation.
● We retain prescription copies for regulatory compliance.
6. Shipping and Delivery
● Delivery within 2-7 business days (city-dependent for home collection).
● Home sample collection available only in serviceable areas.
● Shipping charges apply; free shipping on orders above ₹999 (terms apply).
● We are not responsible for delays due to courier issues or incorrect addresses.
7. Pathology Services and Home Sample Collection
● Book tests online; home collection scheduled within 24-48 hours.
● Reports delivered digitally within 24-72 hours post-testing.
● Results certified by NABL-accredited labs.
● Cancellation policy: 50% charges if cancelled post-scheduling.
8. Returns, Refunds, and Cancellations
Medicines:
● OTC medicines/health devices: 7-day return if unopened/sealed.
● Prescription medicines: No returns (as per Drugs Rules); replacement only for damaged goods.
● Refunds processed within 7-10 days to original payment method.
Pathology Tests:
● Full refund if cancelled 24 hours prior to collection.
● No refund post-sample collection.
Non-Returnable Items: Undelivered items, personalized products, intimate hygiene items.
9. Compliance with Indian Laws
● Compliant with Drugs and Cosmetics Act, 1940 & Rules, 1945.
● Registered pharmacy license displayed on site.
● Data localized in India per IT Act, 2000.
● No advertising of prescription drugs.
10. User Responsibilities
● Provide accurate health/medical information.
● Use medicines as prescribed by doctor.
● Report adverse effects immediately.
11. Limitation of Liability
● We are not liable for misuse of products or medical advice.
● Total liability limited to order value.
● Services provided “as is” without warranties.
12. Intellectual Property
● All content on Swasthkart.com is our property.
● Unauthorized use prohibited.
13. Termination
● We may suspend/terminate accounts for violations.
● You may stop using services anytime.
14. Governing Law
● Governed by laws of India; jurisdiction in Lucknow courts.
